Senior Employee Benefits Investigator

As a Senior Investigator, the incumbent initiates, plans, coordinates, conducts and manages extremely broad, difficult civil and criminal investigations of large and varied employee benefit plans, service providers, trust departments, and other financial entities having relationships and conducting transactions with employee benefit plans. The incumbent performs a range of activities required to:
(1) assess the fiduciary conduct and/or criminal actions of plan officials and service providers; (2) determine the appropriateness of the plan's investment in financial products and services; and (3) evaluate compliance with the ERISA reporting, disclosure, and bonding standards and related civil and criminal Federal laws. The cases are complicated by the potentially broad scope of the investigation, the complexity of the organizational and financial relationships and multiple entities involved, economic and/or political sensitivities, presence of incomplete or complex accounting and financial management records, the presence of multiple violations and complex and unresolved legal issues, and the involvement of several jurisdictions and/or states. In leading and coordinating major investigations and enforcement projects, the incumbent:
(1) Determines areas of coverage for each investigation and the general investigative approaches; (2) Ensures review of plan administrative operations and financial control systems, financial data and relevant records, reports, and other documents; (3) Oversees the interview process to determine the fiduciary conduct of officials associated with the plan, the prudence of the plan's investment in financial products and services, and the propriety of specific transactions; (4) Determines if the plan is administered and operated solely in the interest of the participants and in accordance with the provisions of ERISA; (5) Identifies specific patterns of transactions or situations which indicate imprudent investments, excessive or improper expenditures, prohibited transactions, inadequate financial control systems, excessive charges by service providers, or other improper or illegal actions; (6) Analyzes and determines the impact of identified transactions or situations on plan operations and the present and future financial status of the plan; (7) Applies and interprets applicable provisions of ERISA as well as the applicable provisions of related Federal civil and criminal statutes, regulations, case precedents, exemptions, advisory opinions, etc.; (8) Develops and prepares, or coordinates the preparation of, comprehensive and well-documented reports, work papers and analyses which present findings, cite applicable ERISA violations and related statutes/regulations, and substantiate conclusions; (9) Develops recommendations for voluntary compliance, referral for litigation, case closing or other related agency actions; (10) Negotiates with plan officials, fiduciaries, attorneys, etc. to secure voluntary compliance, to obtain monetary restitution, or to seek other appropriate remedial actions; and (11) Proposes or develops written recommendations for compliance and/or settlement actions subject to formal agency approval. Incumbent provides leadership and guidance to case team members, as well as direction and leadership on investigative techniques and interpretations of regulations. Reviews and evaluates investigative/project findings, and coordinates the production and review of the work products, including reports and spreadsheets prepared by team investigators, and oversees the integration and consolidation of case findings and analyses into final reports. Incumbent works closely with other EBSA investigators, auditors, supervisors, and managers within the office and other regional and national offices in the Agency. Leads or participates in inter-agency investigative teams. Provides litigation support on cases by working closely with regional office management, the Department's Office of the Solicitor (SOL) or Department of Justice in preparing litigation cases. To be considered minimally qualified for this GS-13 position your application must demonstrate in-depth knowledge of Employee Retirement Income Security Act (ERISA). Applicants must have 1 year specialized experience at a level of difficulty and responsibility equivalent to the GS-12 grade level in the Federal Service. Specialized experience is experience that equips the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position, and that is typically in or related to the position being filled. Specialized experience includes work as a compliance inspector, analyst, planner or investigator, whose duties and responsibilities are related to the field of employee benefit plans and/or complex Federal and/or complex state financial regulatory statutes.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
